The Bank’s Attorneys Just Don’t Get It Either!

I just heard from Jane that she received a telephone call from the attorneys representing the bank attempting to foreclose on her home.
The message went something like this:
“Hi, this is _________ from Foreclosure Mill Central, and I’m calling in reference to the motions you had filed, accepted for hearing on ________. I’m wondering if your reasoning behind this is, are you trying to keep the house in _______ or are you trying to make sure you don’t have to pay any deficit?
I noticed you show your address as being on ________ drive, so I’m trying to figure out if you are trying to save the house in ______. Please give me a call and I can direct you to the right person, if that’s what you are trying to do is save the house. ”
I think this is an interesting development. Either this attorney is too stupid to have figured out that Jane is truly interested in fighting the foreclosure, or she’s afraid of having to answer to a judge as to why they didn’t give her proper notice on their hearing. I think it’s actually the latter — Jane wants her day in court!
If they can distract her with a loan mod, they can avoid appearing before a judge to explain why they’re trying to foreclose on something that they don’t have the legal authority to foreclose on.
Also, I personally would think twice about calling the attorney back. She is the attorney working for the bank who is trying to take Jane’s home, not someone who is really interested in helping her keep her house! They are attempting to collect a debt, basically, and will use any information they get from her on the phone against her the first opportunity they get.
As a related note, yesterday I talked to some homeowners in Illinois, in a different county, who are fighting foreclosure, where the attorneys representing the bank AND the judge had never heard of a loan audit! It’s hard to believe that people foreclosing haven’t heard of this grassroots movement to save homes from foreclosure, but at this point nothing surprises me anymore.
I think things are getting interesting — Jane’s fighting back, and while she hasn’t won yet, she has nothing to lose by pushing back against the bank. I hope more of you find the courage to do the same!
