The Bank’s Attorneys Just Don’t Get It Either!

February 2, 2010 by christine

I just heard from Jane that she received a telephone call from the attorneys representing the bank attempting to foreclose on her home.

The message went something like this:

“Hi, this is _________ from Foreclosure Mill Central, and I’m calling in reference to the motions you had filed, accepted for hearing on ________. I’m wondering if your reasoning behind this is, are you trying to keep the house in _______ or are you trying to make sure you don’t have to pay any deficit?

I noticed you show your address as being on ________ drive, so I’m trying to figure out if you are trying to save the house in ______. Please give me a call and I can direct you to the right person, if that’s what you are trying to do is save the house. ”

I think this is an interesting development. Either this attorney is too stupid to have figured out that Jane is truly interested in fighting the foreclosure, or she’s afraid of having to answer to a judge as to why they didn’t give her proper notice on their hearing. I think it’s actually the latter — Jane wants her day in court!

If they can distract her with a loan mod, they can avoid appearing before a judge to explain why they’re trying to foreclose on something that they don’t have the legal authority to foreclose on.

Also, I personally would think twice about calling the attorney back. She is the attorney working for the bank who is trying to take Jane’s home, not someone who is really interested in helping her keep her house! They are attempting to collect a debt, basically, and will use any information they get from her on the phone against her the first opportunity they get.

As a related note, yesterday I talked to some homeowners in Illinois, in a different county, who are fighting foreclosure, where the attorneys representing the bank AND the judge had never heard of a loan audit! It’s hard to believe that people foreclosing haven’t heard of this grassroots movement to save homes from foreclosure, but at this point nothing surprises me anymore.

I think things are getting interesting — Jane’s fighting back, and while she hasn’t won yet, she has nothing to lose by pushing back against the bank. I hope more of you find the courage to do the same!

Stay tuned! We’ll keep updating you on Jane’s story!

    Hi Kristine!!!

You are my kind of girl!!!
There are millions of us who are fed-up with this bullcrapp these banks are doing..
There got to be some kind of way to find someone to do a classa-ction law suite agains
    these bustards!!

It is unreal what is happening in this country.

Kristine we got to go nation wide with this.
I am sure that people will gladly help to fund this opposition with donations!!!!!!.
You just need to get the word out more and to the right people.
My self I am willing to help all I can.

Last April my credit score was 825 and having some money in the banks
all three banks refuse to give me a loan for $20,000.00 to buy new van even tho I was
putting $20,000.00 down for this $40,000.00 van.
Chase - Bank of America - fifth/third they all refuse to borrow me money.

I owe 4 properties in Arizona.
I Never mist the payments in my whole life and
thanks to the Wall-street and rest of the greed stricken banks my life time investments are
    ruined.
What makes it even worst is that we have to bail out these bustards and now they making life
even more miserable fore all of us again.
I did everything right whole life --- Washington Mutual went bankrupt ---NOT ME!!!!!!
And I have to suffer for it.

Why is it that Washington Mutual goes bankrupt and I have to pay for their mistakes!!!!

Why can't I buy my house back for pennies on the dollar like Chase can..

Hope there are some Attorneys who have a vision and see the opportunity that is there to go agains these munsters.

Believe me I can feel it - things will change!!!

Just tell people to keep all the paper work safe for records ---- they will get reimbursement later.!!!!

The last word - GO KRISTINE - GO Girl !!!!!!!!!

    Thanks for info.. Mike.

Interesting concept. I wouldn't also call back this attorney, as any information gathered could be used in the court case irregardless...or a call/message after hours just saying that nothing can be discussed and it'll all come out at the hearing.
