Dial the attorney&#039;s office phone number and ask for the person&#039;s name who signed the assignment. MERS is probably the party who should be bringing the action but is not -- they&#039;re a database! They assign the mortgages at the last minute to the servicer using a flimsy assignment by someone who doesn&#039;t even work for them. This is fraud and if you don&#039;t explain to the court what&#039;s going on, they will take your home.</description>

		<description>Bank of America recently filed an Assignment of Deed of Trust on our house naming MERS as the Assignee (obviously to take over the forclosure process for them on our home).  &lt;br&gt;Question:  From what I have read here, it appears that Mers has no authority to pursue such action.  Any comment ?</description>
